This website Terms of Use is a legally binding agreement between you and Glitters International (“Glitters,” “our,” “we,” or “us,”), a partnership firm, incorporated under the laws of India, having its office at 321, Wadala Udyog Bhavan, Naigaon Cross Road, Next to Wadala Telephone Exchange, Wadala (W), Mumbai 400031, Maharastra, India, and includes its subsidiary and affiliate companies. The Terms of Use govern the use of our website (https://glittershardware.com/) (“Site”). By accessing and using our Site, you are bound by the Terms of Use and Privacy Policy.

We retain the right to amend these Terms of Use without providing advance notice. Your continued use of the Site subsequent to any such alteration signifies your acceptance and commitment to adhere to the revised Terms of Use. The most recent revision date for these Terms of Use is indicated above, thus it is advisable to revisit periodically for any updates.

1. Definitions

1.1. Content shall have the meaning as specified in Clause 2.1.

1.2. Consumer shall mean any individual or entity who visits, browses, registers on, or makes a purchase through the Glitters website or platform.

1.3. Consumer Materials shall have the meaning as specified in Clause 4.4.

1.4. Intellectual Property shall mean all forms of intellectual property subsisting under the laws of India and all analogous rights subsisting under the laws of each and every jurisdiction throughout the world, and includes any and all rights related to product and/or work owned and created by Glitters, as well as intangible assets including but not limited to patents, trademarks, service marks, trade names, registered designs, copyrights, and trade secrets.

1.5. Third-Party Content shall have the meaning as specified in Clause 5.1.

1.6. Feedback shall have the meaning as specified in Clause 11.1.

2. Authorized Uses of Site

2.1. You are permitted to utilize the Site, as well as the information, written materials, images, and/or other content that you encounter through the Site (individually or collectively referred to as the "Content"), exclusively for your personal, non-commercial purposes and/or to gain knowledge about Glitters products and services. This usage must strictly adhere to the terms outlined in these Terms of Use.

2.2. Please note that your use of, or access to, any of our products or related services, whether free or paid, shall be governed by our Sales Agreement and/or Non-Disclosure Form (where applicable), in addition to being subject to these Terms of Use.

3. Restricted Uses of the Site

3.1. You shall not:

License, sublicense, rent, lease, and distribute the Sites to any third party except as permitted by these Terms of Use.
Access or conduct searches on the Sites (including downloading any data or content contained therein or transmitted thereby) by means of any engine, software, tool, agent, device, or mechanism, which includes but is not limited to spiders, robots, crawlers, or any other comparable data mining tools except using Site features expressly provided for this purpose.
Utilize the Sites in ways that extend beyond the rights explicitly granted in these Terms of Use.
Engage in reverse engineering, disassembling, decompiling, decoding, or any other efforts to extract or obtain unauthorized access to any software component of the Site, whether in its entirety or in part.
Modify, alter or generate derivative works based on the Site either in whole or in part.
Employ the Site for any unethical, immoral, unfair, illegal purposes or actions amounting to misappropriation, including but not limited to providing or publishing content that is false or infringes upon someone’s privacy rights.

This includes activities such as network discovery, port and service identification, vulnerability scanning, password cracking, remote access, or penetration testing of the Site.
Circumvent or disable any security or technological features or measures of the Site.
Utilize the Site in a way or for any purpose that infringes upon, misappropriates, or otherwise breaches the intellectual property rights or other rights of any individual or entity, or that contravenes any applicable laws.
Obstruct or disrupt the integrity or efficiency of the Site, or the data and content within it, or transmitted through it.

4. Intellectual Property

4.1. The Site is built on Glitters' proprietary technology. The Sites, Content and proprietary technology are safeguarded by relevant Intellectual Property and legal regulations, encompassing inter alia trademark, patent and copyright laws. All Intellectual Property rights associated with the Site and Content are owned by Glitters. Glitters retains all Intellectual Property for the Site and Content.

4.2. ‘Glitters International’, ‘Glitters’, Glitters logo and other marks of Glitters, are considered trademarks and are the property of Glitters. The visual appearance, layout, colour scheme, and design of glittershardware.com are protected as Glitters’ Intellectual Property. Consumers are not granted any rights or licenses to use the aforementioned Intellectual Property except as expressly specified in these Terms of Use.

4.3. Glitters reserves the right to use and incorporate any suggestions or feedback you provide into the Site or Related Services, without requiring payment or any conditions.

4.4. You affirm that you possess full ownership, legal rights, and interests in the content or materials you share on the Site or provide to Glitters (referred to as "Consumer Materials"). This includes, but is not limited to, having obtained any necessary consents, authorizations, releases, clearances, or licenses from third parties that are essential for you to offer, post, upload, input, or submit these Consumer Materials.

4.5. You further assure that the posting of these Consumer Materials does not constitute a violation or infringement of any patents, copyrights, trademarks, trade secrets, rights of privacy, rights of publicity, moral rights, or any other intellectual property rights recognized by any relevant jurisdiction. It also does not breach any agreements with any other individuals or entities.

4.6. Subject to Clause 7, you also guarantee that the posted Consumer Materials do not include any content that is libelous, false, defamatory, offensive, or in violation of any other applicable laws or regulations. You agree not to knowingly provide misleading information or engage in any fraudulent activities. You additionally affirm that the Consumer Materials you provide comply with these Terms of Use.

4.7. Glitters upholds the intellectual property rights of others and expects its users to do the same. Glitters reserves the right, at its sole discretion, to suspend access or terminate the accounts of users who infringe upon the intellectual property rights of others.

4.8. If you believe that your work has been copied in a manner that constitutes infringement on Glitters’ website, kindly furnish the following information to Glitters at info@glittershardware.com.

5.1. The Site may contain links to third-party websites or information that have been incorporated solely for your convenience. The content expressed, authored, or provided by other users or third parties on the Site (referred to as "Third-Party Content"), reflects the viewpoints and contributions of the respective authors or creators. Such Third-Party Content neither constitutes nor implies an endorsement, sponsorship, or recommendation by Glitters. GLITTERS DISCLAIMS ANY RESPONSIBILITY OR LIABILITY, WHETHER DIRECTLY OR INDIRECTLY, FOR ANY HARM OR LOSS RESULTING FROM YOUR USE OF OR RELIANCE ON ANY PRODUCTS, WEBSITES, OR INFORMATION OBTAINED FROM ANY THIRD-PARTY SERVICE OR THIRD-PARTY CONTENT. The responsibility lies with you to assess the information, opinions, advice, or any other content found on third-party websites.

6. Limitation of Liability

6.1. Glitters, along with its service providers, licensors, and suppliers, does not provide any guarantees regarding the suitability, reliability, availability, timeliness, security, or accuracy of the Site or its Content for any particular purpose. To the fullest extent allowed by applicable law, all information, software, products, services, and related graphics provided on the Site are offered "as is" and “as available” basis without any warranty or condition of any kind. Glitters and its service providers, licensors, and suppliers explicitly disclaim all warranties and conditions, including implied warranties or conditions of merchantability, fitness for a specific purpose, title, and non-infringement.

6.2. To the greatest extent permitted by applicable law, under no circumstances shall Glitters and its service providers, licensors, or suppliers be held liable for any direct, indirect, punitive, incidental, special, consequential, exemplary, or other types of damages (including, but not limited to, damages for cover, damage to goodwill, loss of data, revenue, profits, or other intangible losses) arising from or in any way connected with the use or performance of the Site or any Content.

6.3. In the event that Glitters is found to be liable by the Courts of Mumbai, Maharashtra, to you or any third party for any loss, harm, or damage, you agree that the total liability of Glitters, as well as its officers, directors, managers, employees, affiliates, agents, contractors, service providers, licensors, or suppliers, shall, in all cases, be limited to INR 25,000.

7. Product Representation Disclaimer

In the event of any defect, the Glitters’s return and refund policy shall exclusively govern the available remedy. Under no circumstances shall our liability for product defects exceed the basic or discounted price you paid for the product.

8. Products and Orders

8.1. All prices are listed in USD and are subject to change without notice. Prices displayed at the time of order confirmation will apply. We are not responsible for any pricing errors, typographical error, or any other errors that appear on the Site.

8.2. Your order constitutes an offer to purchase, which we may accept or reject at our discretion. An order confirmation is issued upon successful payment.

8.3. Product availability depends on the stock of the product and is subject to change. We reserve the right to cancel any order if a product is out of stock or unavailable.

8.4. We ship products worldwide. Shipping costs and estimated delivery times are provided at checkout. In addition, any customs or import taxes applicable are to be paid by you in addition to the product and shipping cost paid on the Site.

8.5. Title and risk of loss pass to you upon our transfer of the products to the carrier. Estimated delivery times are for reference only. We are not responsible for delays caused by carriers, customs, or events beyond our control (e.g., weather, strikes).

9. Indemnity

13. Glitters Account

13.1.
